Terms of Service

1. Eligibility

You must be at least 18 years old and capable of forming a binding contract to use the Service. By using the Service, you represent and warrant that you meet these requirements.

2. Accounts

When you create an account, you must provide accurate, complete, and current information. You are responsible for safeguarding your password and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

3. The Marketplace

The Puppy Wag is a platform that connects puppy buyers with breeders. We are not a party to any transaction between buyers and breeders. We do not own, breed, sell, or deliver any animals.

• Breeders are solely responsible for the accuracy of their listings, the health and welfare of their animals, and compliance with all applicable local, state, and federal laws and regulations regarding animal breeding and sales.
• Buyers are responsible for conducting their own due diligence before purchasing a puppy, including verifying breeder credentials, reviewing health records, and understanding any health guarantees.

4. Breeder Obligations

By listing puppies on The Puppy Wag, breeders agree to:

• Provide truthful and accurate information about their puppies, breeding practices, and kennel
• Comply with all applicable animal welfare laws and regulations
• Respond to buyer inquiries in a timely manner
• Honor any health guarantees or return policies stated in their listings
• Maintain appropriate veterinary care and living conditions for all animals

5. Prohibited Conduct

You agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable laws
• Post false, misleading, or fraudulent listings or information
• Harass, abuse, or threaten other users
• Attempt to gain unauthorized access to the Service or other users' accounts
• Use automated systems (bots, scrapers) to access the Service without our written consent
• Circumvent the platform to avoid fees or conduct transactions outside the Service
• List animals that are illegally obtained, endangered, or prohibited by law

6. Payments and Fees

Certain features of the Service may require payment. All payments are processed through Stripe. By making a payment, you agree to Stripe's terms of service. All fees are stated at the time of purchase and are non-refundable unless otherwise specified.

We may charge breeders a platform fee on transactions conducted through the Service. Current fee schedules are available on our pricing page.

7. Intellectual Property

The Service and its original content (excluding user-provided content) are owned by The Puppy Wag and are protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, or create derivative works from any part of the Service without our express written permission.

By posting content on the Service (photos, descriptions, reviews), you grant us a non-exclusive, worldwide, royalty-free license to use, display, and distribute that content in connection with operating the Service.

8. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that the Service will be uninterrupted, secure, or error-free. We do not guarantee the accuracy, quality, or health of any animals listed on the platform. We do not endorse any breeder or guarantee any transaction.

9. Limitation of Liability

To the fullest extent permitted by law, The Puppy Wag shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from:

• Your use of or inability to use the Service
• Any transaction or relationship between buyers and breeders
• Any unauthorized access to or use of our servers
• Any bugs, viruses, or other harmful code transmitted through the Service

10. Indemnification

You agree to indemnify and hold harmless The Puppy Wag and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, or expenses (including reasonable attorney's fees) arising out of your use of the Service, your violation of these Terms, or your violation of any rights of another party.

11. Dispute Resolution

Any disputes arising out of or relating to these Terms or the Service shall first be attempted to be resolved through informal negotiation. If informal resolution is not successful, disputes shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association.

12. Termination

We may terminate or suspend your account and access to the Service at our sole discretion, without prior notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties, or for any other reason.

13. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on this page and updating the "Last updated" date. Your continued use of the Service after changes are posted constitutes acceptance of the revised Terms.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law provisions.
